Terms of Service

I. Acceptance of Terms
By accessing or using the Whattaplace website, mobile site, or related apps (collectively, the “Platform”), you confirm that you are competent to contract under the Indian Contract Act 1872 and that you agree to be bound by these Terms as a legally binding agreement with Whattaplace Technologies Pvt Ltd (“Whattaplace,” “we,” “us,” or “our”). If you do not agree, you must refrain from using the Platform.
II. Definitions
Term
Meaning
Guest
A user who searches for, books, or otherwise uses a space via the Platform.
Host
A user who lists, controls, or makes available a space (“Listing”) on the Platform.
Booking
A time-bound licence to use a Listing for creative, professional, or community purposes.
Fees
Service, platform, or processing fees charged by Whattaplace to Guests and/or Hosts.
Content
All text, photos, videos, reviews, ratings, and other materials uploaded, posted, or transmitted on the Platform by any party.
III. Eligibility & Account Creation
You must be at least 18 years old.
One natural person = one verified account; business entities must designate an authorised signatory.
You are responsible for safeguarding login credentials. See Section XVI on security & data.
IV. Modification of Terms
Whattaplace may amend these Terms at any time. We will post the revised Terms with an “updated” date. Continued use after amendments constitutes acceptance.
PART A – GUEST TERMS
V. Searching & Booking
Request: Submit intended activity, head-count, date, and time.
Host Response: A Host has 24 hours to accept, decline, or propose edits.
Payment: When a Host accepts, you authorise Whattaplace’s payment partner (e.g., Razorpay) to (a) place an authorisation hold or (b) charge the Total Price (Rental + Fees + Taxes) immediately, depending on the Host’s payout settings.
You may not exceed the agreed-upon use, timing, or number of attendees without Host consent.
VI. Cancellations, Modifications & Refunds
Cancellations are governed by the standalone Cancellation Policy (link). Summary:
≥ 7 days before start → full refund of Rental; Whattaplace service fee non-refundable.
7 days – 24 hours → 50 % refund of Rental; all Fees non-refundable.
< 24 hours → no refund.
“Free cancellation window” = 24 hours after Booking confirmation (but at least 48 hours before start). A full refund is available during this window.
VII. Guest Responsibilities & Assumption of Risk
You agree to (a) comply with local laws, building rules, noise limits, and occupancy caps; (b) leave the space and common areas in the same condition; (c) obtain any film/photography/consumption permissions or insurance required by law; (d) accept all inherent risks of staging creative activity in third-party spaces.
PART B – HOST TERMS
VIII. Listing & Managing Your Space
Accuracy: Provide truthful descriptions, pricing, rules, and documentation (property tax receipt, PAN, municipal permissions).
Residential Use Compliance: If a residential property is listed, you confirm that hourly creative use is permitted under local bye-laws; you will secure any society or RWA approvals.
Taxes & TDS: Whattaplace will deduct 1 % TDS under s. 194-O of the Income-Tax Act on Host payouts and deposit the same to the government. PAN must be furnished.
Accept/Decline: You retain discretion to accept or reject Booking requests but must respond within the stated timeframe.
Insurance & Indemnity: We strongly recommend Hosts maintain adequate property and liability insurance.
IX. Cancellations & Reservation Issues
If you cancel after accepting, or the space materially differs from the Listing, Whattaplace may (a) reallocate the Guest, (b) impose cancellation fees, (c) adjust search ranking, or (d) suspend or remove the Listing.
PART C – GENERAL TERMS
X. Fees, Payments & Payouts
Service Fee: Whattaplace charges up to 10% of the Rental from the Guest, and/or up to 25% from the Host, visible at checkout or dashboard.
Payment Processing: All payments are routed through RBI-authorised gateways; Whattaplace never stores card data.
Holdbacks: Whattaplace may withhold payouts for up to 48 hours post-event to manage disputes or chargebacks.
XI. Platform Rules & Prohibited Activities
No unlawful activities, illegal filming, weapons, explosives, narcotics, pornography, wildlife, or activities that violate public decency, intellectual-property, or environmental regulations. Whattaplace reserves the right to remove Content or Listings that breach these rules.
XII. Content & Licence
By posting Content, you grant Whattaplace a worldwide, royalty-free, sub-licensable licence to use, adapt, publish, and display that Content for Platform operation, marketing, or partnership purposes. You represent that you own or control the rights to all Content you upload.
XIII. Reviews
Reviews must be accurate, free from harassment, and comply with our Community Guidelines. We may remove reviews that are fraudulent, defamatory, or irrelevant.
XIV. Intellectual Property
All Whattaplace trademarks, logos, illustrations, UI, code and aggregated data are Whattaplace intellectual property. You may not copy, reverse-engineer, or scrape the Platform without written consent.
XV. Termination & Suspension
Whattaplace may, with or without notice, suspend or terminate your account for breach, non-payment, or risks to Platform integrity. Surviving provisions include Sections XII – XIX.
XVI. Security & Data Protection
We use industry-standard SSL and PCI-DSS compliant processors. Personal data is handled per the Privacy Policy . Breach notifications will follow CERT-In guidelines within 6 hours of detection.
XVII. Disclaimers
Whattaplace provides an online marketplace only; we do not own, operate, or control Listings. Except as expressly provided, all services are provided “as-is”.
XVIII. Limitation of Liability
To the maximum extent permitted by law, Whattaplace’s aggregate liability for any claim shall not exceed (a) the total Fees you paid to us in the 12 months preceding the event giving rise to liability, or (b) INR 10,000—whichever is lower.
XIX. Indemnity
We use industry-standard SSL and PCI-DSS compliant processors. Personal data is handled per the Privacy Policy . Breach notifications will follow CERT-In guidelines within 6 hours of detection.
XX. Governing Law & Dispute Resolution
These Terms are governed by Indian law. Parties shall first attempt amicable settlement; failing that, disputes will be referred to arbitration under the Arbitration & Conciliation Act 1996. Seat of arbitration: New Delhi. Subject-matter courts at New Delhi shall have exclusive jurisdiction for any court proceedings.
XXI. Miscellaneous
Assignment: You may not assign these Terms without our consent; we may assign to an affiliate.
Severability: If any provision is held invalid, the remainder stays in effect.
Force Majeure: Whattaplace is not liable for delay/failure caused by events beyond reasonable control.
Entire Agreement: These Terms, together with linked policies (Privacy, Cancellation, Payments), constitute the entire agreement.
